Terms of service

1. GENERAL PROVISIONS

1.1. This Terms of service governs the provision of services by private company Myna Ltd (hereinafter referred to as the “Provider”) to any individual or legal entity (hereinafter referred to as the “Client”).

1.2. Acceptance (full agreement to the terms of this document) is deemed to occur when the Client pays for the services. From the moment of acceptance, the Terms of service is considered concluded.

2. SUBJECT OF THE AGREEMENT

2.1. The Provider offers the Client a subscription-based service to the Myna web application for management accounting and financial analytics, and the Client agrees to pay for these services.

2.2. The services are provided in a SaaS (Software as a Service) format via the Myna web application.

3. RIGHTS AND OBLIGATIONS OF THE PARTIES

3.1. The Provider undertakes to:

  • Provide access to the Myna software via the web application;
  • Offer consultation on system usage;
  • Ensure the security and protection of the Client’s data in accordance with the laws of the Republic of Kazakhstan;
  • Provide technical support and system updates;
  • Anonymize Client data for training and improvement of the system algorithms.

3.2. The Client undertakes to:

  • Timely pay for services according to the chosen plan;
  • Provide accurate information for using the software;
  • Comply with the rules for using the Myna web application.

4. SERVICE FEES AND PAYMENT PROCEDURE

4.1. The current pricing plans are available on the Provider's official website (www.myna.one) and may be changed with a 10-calendar-day prior notice to the Client.

4.2. Individual payment terms and discounts are arranged in a separate agreement or confirmed in written correspondence between the parties. Such terms take precedence over the standard contract terms.

4.3. Payment confirms acceptance of the Terms of service and serves as the basis for providing access to the service.

5. SERVICE DELIVERY PROCEDURE

5.1. Access to the Myna web application is granted to the Client after payment confirmation.

5.2. All consultations are provided online and included in the service fee as per the selected plan.

5.3. In case of non-payment, access to the service may be temporarily suspended until the debt is settled.

6. REFUND POLICY

6.1. Refunds are available only for new Clients within 14 calendar days from the date of initial payment, provided that the Client has not actively used the service.

6.2. Active use of the service includes, but is not limited to: creating of managing transactions, creating financial models, or using more than 10% of the available features in the subscribed plan.

6.3. Refund requests must be submitted in writing to support@myna.one and include:

  • Client account information;
  • Payment confirmation details;
  • Reason for the refund request.

6.4. The Provider will process refund requests within 10 business days from the date of receipt. Approved refunds will be returned using the original payment method within 14 business days.

6.5. The following situations are not eligible for refunds:

  • Payments for services already rendered or actively used;
  • Subscription renewals after the first billing period;
  • Termination of service by the Client after the 14-day refund period;
  • Service suspension due to Client's violation of the Terms of service;
  • Dissatisfaction with features that were clearly described on the website or in promotional materials.

6.6. For subscription plans paid annually or for extended periods, refunds are prorated based on unused months, minus a processing fee of 10%, and are only available within the first 30 calendar days of the initial subscription period.

6.7. Custom development work, individual consultations beyond the standard plan, and third-party integration services are non-refundable.

6.8. In cases where the Provider fails to provide the agreed-upon service due to technical issues on the Provider's side for more than 72 consecutive hours, the Client is entitled to a prorated refund for the affected period or a subscription prolongation for a period of technical issues.

7. CONFIDENTIALITY AND DATA PROTECTION

7.1. The Provider agrees not to disclose or use Client information for purposes unrelated to fulfilling this agreement.

7.2. All data entered by the Client into the system is their property and will not be shared with third parties without their consent. The Provider has the right to use anonymized data for training and improving its algorithms.

8. TERM AND MODIFICATION OF TERMS

8.1. The agreement becomes effective upon the Client’s acceptance of the Terms of service and remains valid until the services are no longer used.

8.2. The Provider has the right to make changes to the Terms of service, notifying the Client no less than 10 calendar days before the changes take effect.

8.3. The Client may terminate the agreement at any time by notifying the Provider in writing. Payments for services already rendered are non-refundable unless otherwise specified in Section 6.

9. LIABILITY OF THE PARTIES

9.1. The Provider is not liable for failures in the web application caused by force majeure, technical issues with service providers, or actions of third parties.

9.2. The Client is responsible for the accuracy of the information provided and compliance with the terms of use of the web application.

10. FINAL PROVISIONS

10.1. All disputes and disagreements arising from this agreement shall be resolved through negotiations. If no agreement is reached, the dispute shall be submitted to the court at the Provider’s registered location.

10.2. This Terms of service is public and available for review on the Provider's website.

11. TECHNICAL SUPPORT

11.1. Technical support is available on business days from 9:00 AM to 6:00 PM CET through the channels listed in the web application at www.myna.one/support or via email at support@myna.one.

11.2. The average response time to requests is 2 hours during working hours.

12. PERSONAL DATA PRIVACY

Personal data privacy policy is available on the web-site https://www.myna.one.

13. INTELLECTUAL PROPERTY

13.1. All rights to the Myna web application, including source code, design, logos, and trademarks, belong to the Provider.

13.2. The Client is granted a non-exclusive license to use the web application during the subscription period.

14. FORCE MAJEURE

14.1. The parties are exempt from liability for partial or complete failure to fulfill obligations under this agreement if such failure results from force majeure.

14.2. Force majeure includes natural disasters, wars, strikes, legal changes, and failures of internet providers and servers.

15. FINAL PROVISIONS

15.1 Entire Agreement

This agreement constitutes the entire agreement between Provider and Client regarding the terms of service.

15.2 Severability

If any provision of this agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Language

In case of any discrepancy between language versions of this agreement, the English version shall prevail (this version).
